1. Introduction

Welcome to PE Games, a mobile application owned and operated by ConnectedPE Pty Ltd ("ConnectedPE," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of the PE Games mobile application and any related services (collectively, the "Service").

By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

2. Definitions

"App" refers to the PE Games mobile application.

"Content" refers to all text, information, graphics, audio, video, and data offered through the App.

"Subscription" refers to the recurring payment plan that grants access to premium features of the App.

"User," "you," and "your" refer to the person or entity using the App.

3. Account Registration

To use certain features of the Service, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription Terms and Billing

The App offers subscription-based access to premium features. By subscribing, you agree to the following terms:

Subscription fees will be charged to your payment method through your Apple App Store or Google Play account.
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage your subscription and turn off auto-renewal by going to your account settings in the App Store or Google Play after purchase.
If the subscription price changes, you will be notified and have the opportunity to accept the new price before your next subscription period.

5. Free Trials

We may offer free trials to new users. If you sign up for a free trial, you will have access to premium features for the specified trial period. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

You may only use one free trial per account. We reserve the right to determine eligibility for free trials and to modify or terminate free trials at any time without notice.

6. Cancellation Policy

You can cancel your subscription at any time by going to your account settings in the App Store or Google Play. Cancellations take effect at the end of the current billing period.

We do not provide refunds for partial subscription periods, except where required by applicable law.

7. User Content and Conduct

You may have the ability to create, post, or share content through the App. You retain ownership of any content you create, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content in connection with the Service.

You agree not to use the Service to:

Violate any applicable law or regulation.
Infringe the rights of any third party, including intellectual property rights.
Transmit any material that is defamatory, offensive, or otherwise objectionable.
Interfere with or disrupt the Service or servers or networks connected to the Service.
Attempt to gain unauthorized access to any part of the Service.

8. Intellectual Property Rights

The App and its original content, features, and functionality are owned by ConnectedPE Pty Ltd and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App, except as permitted by these Terms.

9. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection and use of your information.

10. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT WILL CONNECTEDPE PTY LTD, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF WARRANTIES OR LIMITATION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to defend, indemnify, and hold harmless ConnectedPE Pty Ltd, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Service shall be instituted exclusively in the courts of Australia, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.

14. Changes to Terms

We may revise these Terms at any time by updating this page. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised Terms.
